In Pennsylvania, school attendance is compulsory and thus parents are mandated to entrust their children to our education system. It is from this foundation that the duty of teachers to act as a fiduciary in their students’ best interest and to create and maintain a safe environment for their students derives. The overwhelming majority of educators in Pennsylvania exercise their fiduciary responsibilities with care and conviction. The few who breach their duties, however, undermine the profession and leave a trail of devastation, particularly with student victims. It has been our experience that when a teacher enters into an inappropriate relationship with a student, the teacher violates the recognized student-teacher boundary and thereby redefines the boundary inappropriately. For example, the teacher-student relationship may initially be appropriate, but at some point the relationship shifts to serving the needs of the teacher and not the needs of the student. In many cases, the teacher takes on a new role with a student, which causes the traditional relationship to become blurred. When teachers become confidants, friends or counselors of students, a dual relationship is created which creates an ambiguity in the student-teacher relationship where roles are less defined.

Student rights are those rights , such as civil, constitutional, contractual and consumer rights, which regulate student rights and freedoms and allow students to make use of their educational investment. These include such things as the right to free speech and association, to due process, equality, autonomy, safety and privacy, and accountability in contracts and advertising, which regulate the treatment of students by teachers and administrators.
There is very little scholarship about student rights throughout the world. In general most countries have some kind of student rights or rights that apply in the educational setting enshrined in their laws and proceduralized by their court precedents. Some countries, like Romania, in the European Union, have comprehensive student bills of rights, which outline both rights and how they are to be proceduralized.

Subscriber Account active since. Aly Oliver, a college student at the University of Colorado at Boulder, is a devoted daughter — and her most recent act of devotion has earned her viral fame. Last week, Oliver made an attempt to set up her single mother with one of her college professors over Zoom. She documented the scheme in a TikTok video, which has racked up 9 million views in under a week. The video then cut to a clip of Oliver’s mother practicing her “accidental” interruption on the call.
In the final clip, Oliver films herself chatting with her professor via Zoom, reminding him that her parents were divorced so she’s staying in two different places during quarantine. Her mother approached and the three proceeded to have a conversation. In just one day, the video was viewed approximately 5 million times, ultimately doubling its views in a week.
The comments section is filled with support for Oliver’s mother and the idea of a mom-professor relationship. While he did not appear thrilled that he’d been secretly recorded, he respected her motivation. The professor went on to say Oliver could leave the video posted to TikTok on the condition that she write a “position statement” for class on issues of intellectual-property rights — “vis a vis TikTok,” including her viral video.
Unfortunately, Oliver had little to share about the progression of the relationship in her latest video. She went on to share her reaction to viral fame “oh, f, this is so awkward” and the email she sent to her professor promising to take the video down if he felt uncomfortable. A cherished belief runs deep in our psyches: A belief in the compassion of teachers whose heroic efforts transform the lives of students. There is truth in the narratives that support this view, but there is also a darker side to this mythos. In a small minority of teachers, an ugly undercurrent of mean-spirited and disdainful conduct toward students also exists. My personal interest in the phenomenon of teachers who bully has its roots in childhood experiences with a few teachers and coaches who waged a daily reign of terror over students.
As an expert in school violence, my professional interest originated years ago while doing teacher in-service training on bullying. While—like most trainers on bullying—I focused on abusive behavior among students, I also raised concerns about the conduct of adults. This usually produced a hush in the audience, followed by requests to speak with me privately.
The common denominator in these narratives was a sense of powerlessness and the conclusion that little was being done or could be done to mitigate the problem. I define teacher bullying as a pattern of conduct, rooted in a power differential, that threatens, harms, humiliates, induces fear in or causes students substantial emotional stress. In order to address the phenomenon of teachers who bully students, the education profession needs to grapple with several inconvenient truths.
In general, bullying by educators is:.
